Arizona employment law, as with most laws, can be confusing to understand for employees and employers alike. The skilled Phoenix employment law attorneys at The Foster Group can help you understand what the laws are, and how to navigate them if you feel that your rights have been violated. Schedule your consultation now. What State Employment Laws Does Arizona Have? As an at-will state, employers and employees in Arizona are able to sever their working relationship at any time, for any reason that isn’t based on discrimination. This is true in cases except those in which there is a contract between the parties stating a length of employment. Arizona also has laws stating that an employer cannot bar a potential employee from gaining employment based on them not being a member of a labor organization or union. The laws regarding this are referred to as “right-to-work” laws.  Employers are allowed to require prospective hires to submit to pre-employment drug testing. In addition, Arizona state law does require new hires to fill out the I-9 and use the E-Verify program to determine the potential employee’s employment eligibility. Employers must keep this information on file for the duration of the employee’s time with their company, or 3 years, whichever is longer.  Arizona state law allows leave for employees for both: Voting leave Jury duty leave In both instances, the employer cannot penalize, or require the employee to use their paid leave or vacation time to handle these duties.  If you believe that your rights that are protected under Arizona state law have been violated, schedule your consultation with the Phoenix employment lawyers of The Foster Group now.  Federally Protected Rights for Employees While Arizona has adopted its own state laws, employers must follow federal laws as well.  Title VII of the Civil Rights Act protects employees from facing discrimination in the workplace based on: Age Disability Sexual orientation Gender Race Religion These federal protections are only applicable to companies (including nonprofits) with at least 15 employees, employment agencies, and state or local government.  Title VII also protects against harassment in the workplace such as sexual harassment, or harassment based on the protected classes How Do These Rights Help You as an Employee? These rights have been federally protected to ensure a safe work environment for employees. Federal laws also help protect employers from being unjustly targeted.  If you find that any of your rights have been violated, gathering any available evidence and contacting a skilled employment law attorney in Phoenix can make all the difference for your claim. The Foster Group understands employment law. We can help ensure that your rights are protected.
